THE SYSTEM OF STATE ANTIMONOPOLY ADMINISTRATION AS A TOOL FOR MANAGING THE MARKET BEHAVIOR OF ECONOMIC ENTITIES

Abstract:
This article provides a theoretical and methodological analysis of the state antimonopoly regulation system in the Russian Federation as an integrated institution for managing the market behavior of economic entities. The relevance of the research is driven by the dual nature of contemporary transformations: first, the digitalization of the economy and the emergence of digital platforms with network effects create novel, non-conventional forms of market power that cannot be assessed within classical analytical frameworks; second, the regulator itself – Federal Antimonopoly Service of Russia (FAS Russia), faces internal managerial challenges that undermine the effectiveness of its supervisory functions. The objective of the study is to substantiate the integrity of the antimonopoly mechanism by identifying interrelations between the evolution of the legal framework, institutional architecture, and strategic priorities of competition policy. The methodological basis encompasses systemic and institutional approaches, as well as the analysis of legal statutes and performance data of the FAS Russia. The paper traces key stages in the development of legislation, from the 1991 RSFSR Law to Federal Law No. 135-FZ, which expanded regulatory scope to financial markets and intellectual property. The multi-tiered structure of the FAS Russia is examined, including its collegial bodies (the Collegium, Presidium, and Tariff Board), which ensure uniform law enforcement and internal oversight. Special consideration is given to strategic tools: natural monopoly reform (principles of “inflation minus” and “network benchmark”), the “fifth antimonopoly package” as a response to digital ecosystem challenges, and the introduction of a marker system to facilitate cartel disclosure. A key contradiction is revealed between the declared objectives and the regulator's operational efficiency: an analysis of the FAS Russia financial management quality for 2024 showed significant deviations in asset management and public procurement compliance. The author concludes that improving antimonopoly regulation requires not only adaptation to market dynamics but also the mandatory integration of antimonopoly compliance into the management culture of the regulator itself. The findings may be applied in law enforcement practice, public administration, and educational programs.
